Obituary

The Honourable Justice David Francis Hurley passed away peacefully after a short illness with his family by his side on Wednesday, July 15, 2020.  He is pre-deceased by his parents John and Rose, his infant brother Kevin, his in-laws Leonard and Madeline Greene, and brother in-law Bill Connors. Leaving to mourn are his wife of 40 years, Maureen Greene, and his children, John and Anne (Elizabeth Cawley), who are deeply saddened by his passing. He will also be sadly missed by his siblings Gervase (Joan), Nick (Gwen), Eugene (Ellen Merrigan), Wayne, Rosemarie (Bern Coffey); his family in-law Bryan (Patricia), Joan (Bob Connors), Shelia Connors, Mabel (Jim Cavanagh), Eleanor Belbin; many nieces and nephews; and countless colleagues and friends. David was born in Avondale and grew up in North River before attending Memorial University. He taught briefly and then pursued a legal education – first obtaining a law degree in 1975 from the University of New Brunswick and then completing a master’s degree in law in 1977 at Dalhousie University. David and his future wife were admitted to the Newfoundland Bar on the same day in 1976 and he received his Queen’s Counsel designation in 2002. He was appointed as a judge of the Supreme Court of Newfoundland and Labrador in 2013. An avid follower of local and global affairs, David was well-known for his intellect, wit, dry sense of humour and quiet friendly nature. The family would like to thank the physicians who provided exceptional care to David over the years, especially Dr. Proton Rahman, Dr. Anne Williams, and Dr. Brendan Barrett. The family would also like to thank the physicians and nurses of both the Intensive Care Unit and 5 North A at the Health Sciences Centre, as well as Dr. Natalie Bridger, for providing excellent care and compassion to David during his recent illness. While David was surrounded by supportive and caring family and friends, the family would like to particularly acknowledge his sister in-law Dr. Mabel Greene and her husband, Jim Cavanagh, for their continuous support and innumerable acts of kindness, especially during his recent illness. In keeping with public health directives and following cremation, a private visitation will take place at Carnell’s Funeral Home, 329 Freshwater Road.   A private funeral service will be held on Monday, July 20 at Mary Queen of Peace Church. Maureen and Family; Sorry to hear of David’s death that I just read about it today in the UNB Alumni news. I met Dave in the fall of 1974 as we were fellow proctors at the Lady Beaverbrook residence on the UNB campus. I remember his wit and his praise for his liberal arts education. On event stands out in my mind; I was arriving late to the LBR dining hall one evening before Easter to find Dave and a few others sitting at a table while Dave alone was eating. In passing I noted salt cod and boiled potatoes with the skins on adorning his plate. I commented that the only thing missing was bacon renderings. I was quickly told that the chef was coming with it and to grab a plate and join him in this Maritime feast. I truly enjoyed our time together and always checked the Alumni News for word of his career.

So sorry to hear the news of Mr. Hurley’s passing. My first job was working at his law firm in 1996 – he was a wonderful man!

I hope it is enough to say Joan and I loved him. His intellect, his wit, his decency, his empathy, his approach to others all made him someone you were drawn to.. I met him in Lady Beaverbrook Residence. 5 or 6 days after my father’s funeral.. In many ways I only appreciated later how he helped me get through a very rough patch. Living in the same house and going to Law School in the day and having our meals together and discussing the days events at night all brought back a sense of normality that I needed. At the time of the wedding in Nl I got to meet Rose and his siblings and we had the best time of our lives with so much laughter that it has stayed with me all these years later. Joan couldn’t be there . In 3 weeks time our son will be 40 years old so that explains that. We are hurt and sad again but we will go on even if somewhat diminished by his passing. Our heartfelt condolences to Maureen and John and Anne and all the family.

I had the privilege to get to know him well when he served as President of the St. John’s East electoral district association and I served as VP. He couldn’t be kept out of the office, diligent about his cases and invested in justice. He was one in a million. So many great memories. The obituary is a fine summary of the life of David Hurley . I have known him for all of his legal career and had many conversations and interactions with him over the years . What you saw was what you got with him -no pretension or trying to be something that he was not . In his legal career he well represented his clients and on the Bench he was courteous -attentive and prepared -those who appeared before him got the square of the board ..He was an all round good person .He had a great interest in things political and was not reluctant to express an opinion on the events of the day . He had a great sense of humor and a sharp wit.
His health issues did not deter him in carrying on with his career -he battled through the issues he confronted .
Those who knew Dave will fondly remember him . He is now at rest and may that eternal rest be in peace . Sincere condolences to Maureen –his children and other family members .
